Who we are
Jolie Smart Garden is a garden and flower shop based in Monaghan, Ireland. We run this website and online store (the “Services”). For the purposes of the EU General Data Protection Regulation (GDPR) and the Irish Data Protection Acts, Jolie Smart Garden is the data controller of the personal information described in this policy. Our store is hosted by Shopify, which processes data on our behalf.
What we collect
- Contact details — your name, billing and delivery address, phone number and email address, when you place an order, use Click & Collect, or contact us.
- Order and payment information — what you bought, the amount, and payment confirmation. Card payments are handled by our payment providers; we never see or store your full card number.
- Communications — emails or messages you send us, including customer support enquiries.
- Newsletter signup — your email address, if you choose to subscribe.
- Device and usage information — IP address, browser and pages visited, collected via cookies (see below).
Why we use it, and our legal bases
- To fulfil your order (contract): processing payment, arranging delivery or collection, handling returns and warranty issues.
- To respond to you (legitimate interest): answering enquiries and providing support.
- To send our newsletter (consent): only if you signed up, and every email includes an unsubscribe link. You can withdraw consent at any time.
- To keep the shop running and secure (legitimate interest): fraud prevention, security, and understanding how the site is used.
- To meet legal obligations (legal obligation): tax and accounting records, and responding to valid legal requests.
We do not sell your personal information, and we do not use it for automated decision-making that produces legal effects.
Cookies
Cookies are small files stored on your device. We use them as follows:
- Strictly necessary cookies — required for the site to work: keeping your cart, remembering your region and currency, secure checkout, and recording your cookie choices. These do not require consent.
- Analytics cookies — help us understand how visitors use the site (pages visited, how you found us) so we can improve it. Set only with your consent.
- Marketing cookies — support advertising and measuring its effectiveness. Set only with your consent.
When you first visit from the EU/EEA or UK, a cookie banner asks for your choice before any non-essential cookies are set. You can accept, decline, or pick categories — and change your mind at any time via the cookie preferences link or by clearing cookies in your browser. Declining non-essential cookies does not affect your ability to shop with us.
The main cookies used by our Shopify-hosted store include:
-
cart,cart_currency,_secure_session_id,localization,_tracking_consent— strictly necessary (cart, checkout, region, your consent choices). -
_shopify_y,_shopify_s,_shopify_sa_p,_shopify_sa_t— analytics and marketing attribution (consent-based).
A full, current list is available in Shopify’s cookie documentation at shopify.com/legal/cookies.
Who we share it with
- Shopify — hosts our store and processes orders on our behalf. See the Shopify Consumer Privacy Policy.
- Payment providers — to process your payment securely.
- Couriers — your name, address and phone number, so your order can be delivered.
- Authorities — only where the law requires it.
All service providers act under contracts that limit what they can do with your data.
International transfers
Some of our service providers (including Shopify) may process data outside the European Economic Area. Where that happens, the transfer is protected by an EU adequacy decision or the European Commission’s Standard Contractual Clauses.
How long we keep it
- Order records: kept for as long as required by Irish tax law (currently 6 years).
- Newsletter details: until you unsubscribe.
- Support correspondence: as long as needed to resolve the matter and for a reasonable period after.
Your rights
Under the GDPR you have the right to:
- Access the personal information we hold about you;
- Correct inaccurate information;
- Erasure (“right to be forgotten”), where we no longer need the data;
- Restrict or object to certain processing;
- Data portability — receive your data in a machine-readable format;
- Withdraw consent at any time, without affecting processing that happened before you withdrew it.
To exercise any of these rights, contact us using the details below. We will respond within one month. We may need to verify your identity first. You will never be charged for a reasonable request, and we will not treat you differently for exercising your rights.
If you are unhappy with how we handle your data, you can lodge a complaint with the Irish supervisory authority: the Data Protection Commission, 21 Fitzwilliam Square South, Dublin 2, D02 RD28, Ireland — dataprotection.ie. If you live elsewhere in the EU/EEA, you may also contact your local data protection authority.
Children
Our Services are not directed at children and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us their information, contact us and we will delete it.
Changes to this policy
If we change how we handle your data, we will update this page and the “Last updated” date above, and give further notice where the law requires it.
